encourage ICANN to set rules on this matter.

If it is your registered Mark, then you do have a right to it no matter who
registered it.

If it is merely a preferred domain name that's already taken, then -

Sorry, you really should know what you are talking about before offering
such incorrect advice.

When you get a trademark you get it for a specific category. You do not
own all uses of that mark.

Examples:

Apple Computer - Apple Record Company
Burlington Coat Factory - Burlington Industries, Burlington Northern
Railroad
Propel Acceleration software - Propel Fitness water

and so forth....
